The Kahnawake gaming commission, established in June 1996 pursuant to law on gambling provisions in Kahnawake (MCR No. 26 / 1996-97), is currently composed of three members nominated by the Mohawk Council of Kahnawake:

The Kahnawake gaming commission regulates interactive gambling licenses in the Mohawk Territory of Kahnawake, in accordance with the laws on Kahnawake gambling. It is authorized to discipline and control game and gaming activities conducted within the Mohawk Territory of Kahnawake, in accordance with the highest principles of honesty and integrity.

In 1999, in application of regulatory powers ascribed to it in section 35 of the law for gambling of Kahnawake, the Commission adopted its rules regarding interactive gaming.

The Commission that has drafted the regulations was assisted by Frank Catania, ex director of the New Jersey Division for the application of gambling as well as world famous authority in gambling observance field, and by Murray Marshall, law officer of the Commission.

Regulations are designed to assure that all interactive games and gaming related activities conducted within the Mohawk Territory of Kahnawake satisfy three basic principles:

  • Only appropriate persons and entities are authorized to operate within Kahnawake:
  • Games offered are fair for players.
  • Winners are paid.

The application process to obtain a Kahnawake license requires the candidate to provide the Commission with wide information about the business entity that the gambling company will manage and about every principle associated with the entity.

Information given by "candidates" are examined by an independent subject paid by the Commission, the National Anti Fraud Centre. It will decide on the eligibility of the applicant.

The Commission adopted technical standards applied to assure that games offered by the holder of a license are fair for players.

There is initial risk analysis prior to implementation and verification plan, established to ensure that the systems used by the applicant meet the requirements of the Commission.

Monitoring and verification operations are scheduled monthly to grant continuing compliance.

In order to guarantee that operators are able to comply with their obligations regarding players, the applicant's financial viability is measured at the time of application and can be reviewed at any time if the Commission believes it necessary.

Regulations also include the submission of various security questionnaires, if the Commission considers it necessary.

About Kahnawake License Prices

The registration fee for an interactive gaming license is $ 5,000 non-refundable.

Applicants have also to submit a $ 15,000 deposit (non-refundable) to cover costs of probity checks and test systems.

With the application, you have to pay a $ 10,000 tax for the first year of operation, but the fee is refundable if the license is not granted. The licenses for interactive games are granted for periods of two years, and the annual fee is $ 10,000. The Commission for Gambling may also authorize a licensed interactive game operator to host a customer-supplier of interactive games. The application fee necessary in order to authorize a customer-supplier of interactive games is $ 5,000, non-refundable. The license holder of the interactive game is responsible to supervise the activities of a client-provider and he is jointly liable for his actions. Applicants must also submit a nonrefundable $ 15,000 deposit to cover the costs of probity and test systems. With the application, it is necessary to pay a $ 10,000 tax for the first year of operation, but the fee is refundable if the license is not granted. The licenses for interactive games are granted for periods of two years, and the annual fee is $ 10,000.

The Commission for Gambling also gives authorized licenses to secondary suppliers clients. A candidate or an authorized client provider may apply for them. If the applicant is making application for authorization of the customer secondary supplier, it must be accompanied by a $ 15,000 fee. If an authorized customer makes an application, it must be accompanied by a $ 5,000 fee and it is valid for two years.

Licenses can also be obtained for each person who plays a leading role in the management of a business licensee. The rate for this type of license is $ 2,500.
